Contract – Home Inspection Agreement

INSPECTION AGREEMENT

This is an agreement between the Clients, and Fulton Home Inspections.

In agreeing to proceed with the inspection of the property, I/we have carefully read, understood, and accepted this Contract.  The Inspection of this property is subject to the Limitations and Conditions set out in this Agreement.  The report is primarily visual, but not technically exhaustive and addresses the readily accessible and visually observable features of this home at the time of this inspection.  The Inspection is performed in accordance with the Standards of Practice of the American Society of Home Inspectors.   A copy of these Standards is included, and available at www.fultonhomeinspections.com

The Home Inspector’s report is an opinion of the present condition of the property at the time of the inspection.  This inspection is for the exclusive use of the client and the client agrees to indemnify Fulton Home Inspections from any claims by third parties to whom the client releases this report.

LIMITATIONS AND CONDITIONS OF THE HOME INSPECTION   

These Limitations and Conditions explain the scope of your Home Inspection.  Please read them carefully before signing this Agreement.

The purpose of your Home Inspection is to evaluate the general condition of a property.  This includes determining whether systems are still performing their intended functions.  There are limitations to the scope of this Inspection.  It provides a general overview of the more obvious repairs that may be needed.  It is not intended to be an exhaustive list.  The ultimate decision of what to repair or replace is yours.

The client is advised that Fulton Home Inspections assumes no liability or responsibility for the costs of repairs/replacement of unreported defects, errors or omissions, current or in the future, or for any property damage or loss that may arise from said defects.

  • This report is not a guarantee, warranty or an insurance policy with regards to the property.
  • This report is not a Building Code or Code Compliance certificate.
  • This report is not a certificate of performance of any kind.
  • The client is recommended to purchase Title Insurance for this residence if available.
  1. The Home Inspection provides you with a basic overview of the condition of the property; the Inspection is not technically exhaustive.
  2. A Home Inspection does not include identifying defects that are hidden behind walls, floors or ceilings. This includes wiring, structure, plumbing and insulation that are hidden or inaccessible.
  3. The Inspection does not include hazardous materials that may be in or behind the walls, floors or ceilings of the property
  4. We are not responsible for, and do not comment on, the quality of air in a building.
  5. The Inspection does not deal with environmental hazards such as the past use of insecticides, fungicides, herbicides or pesticides.
  1. Your Home Inspector does not look for and is not responsible for, fuel oil, septic or gasoline tanks that may be buried on the property.
  2. We will have no liability to the Client for any claim or complaint if conditions have been disturbed, altered, repaired, replaced or otherwise changed before we have had a reasonable period of time to investigate. In the event of a claim against the inspector/Fulton Home Inspections, the client agrees to supply the inspector/Fulton Home Inspections with the following:

(1) Written notification of adverse conditions within 14 days of discovery; and

(2) Access to the premises.

Failure to comply with the above conditions will release Fulton Home Inspections and its agents from any and all obligations or liability of any kind.

All of the other terms of the Agreement (Inspection Contract) are incorporated herein by reference.

  • The parties agree that any litigation arising out of this Agreement shall be filed only in the Court having jurisdiction in the County in which Fulton Home Inspections has its principal place of business.
  •  In the event that the client fails to prove any adverse claims against Fulton Home Inspections in a court of law, the client agrees to pay all legal costs, expenses and fees of Fulton Home Inspections in defending said claims.
  • This Agreement represents the entire agreement between the parties.                                                                                                                                       
  • All prior communications are merged into this Agreement, and there are no terms or conditions other than those set forth herein.
  • No change or modification shall be enforceable against any party unless such change or modification is in writing and signed by the parties.
  • This Agreement shall be binding upon and enforceable by the parties and their heirs, executors, administrators, successors and assignees.
  • Payment of the fee to Fulton Home Inspections is due upon completion of the on-site inspection.
  • The client agrees to pay all legal and time expenses incurred in collecting due payments, including attorney’s fees, if any.
  • This Agreement is not transferable or assignable.

The Client was verbally advised to read this agreement, the limitations and the Standard of Practice attached before signing.

By signing below, I/we acknowledge that we have reviewed, understood, and accepted the Terms and Conditions and the SCOPE OF INSPECTION described above.   I/we also understand that legal liability of the Inspector and the Inspection Company for damages arising from action or inaction, however caused, is limited in amount to the fee paid for this inspection.
